Vexatious claimIn Arabic: الدعوى الكيدية
Definition
A vexatious claim is a claim brought to harm or harass the other party, not to enforce a real right. If the court finds that this is so, it must dismiss the claim.
How it varies across the GCC
Article 3 of the Saudi Law of Procedure before Sharia Courts says that if the court finds the claim to be fictitious or vexatious it must dismiss it, and it may impose a discretionary penalty on the person whose bad faith is established.
The rules that apply to a specific matter depend on the state, any free zone involved and the current text of the law, so check the official source before relying on them.
