Platform details

In Saudi Arabia, the e-service “Statement of claim” is used to file in a general, criminal, civil, commercial, personal-status or labour court, on Najiz. The service does not require a visit to the court unless an SMS asks the beneficiary to attend. If an agent files, the power of attorney must be in force and include authority to plead.[1] Draft the claim here, then file it on Najiz. In the UAE, file on the portal of the competent court and check that court’s language requirements. The Abu Dhabi Judicial Department publishes court e-services, including case registration.[4] The Dubai Courts link is kept so you can open it from a network that reaches it.[5]

A free bilingual statement of claim for a civil or commercial case. It records the court, the parties, the facts, the grounds and the requests. For the definitions, see statement of claim, appeal and statute of limitations. It is not an enforcement request: see enforcement of judgments. If an agent signs, issue the authority with the power of attorney template. The defendant’s reply is the statement of defence, and the notice before filing is the legal notice.

What the statement of claim contains

Order the claim the way the Najiz service orders the filing: classification, then the parties, then the facts and the documents, then submit.[1] The grounds are filled with the provision you rely on, not with an article number pre-written in this template.

  • Write the claimant’s and the defendant’s identity and the national address. The service requires the defendant’s identity to be known.[1]
  • If an agent files, the power of attorney must be in force and include authority to plead.[1]
  • Out of scope: a criminal complaint, an enforcement request, and an end-of-service settlement.
  • This page does not say that a labour claim must go through conciliation first. Check the classification requirements on the official service.

The template

Statement of claim

A draft statement of claim for a civil or commercial case, prepared before it is filed in the competent GCC court. It is not a criminal complaint and not an enforcement request. Replace every [placeholder]. Do not pre-fill article numbers.

1. Court and circuit

To the [name of court] in [city], circuit [●]. Type of claim: [civil / commercial].

›Drafting note

On Najiz you enter the classification of the claim and read its requirements before the rest of the data.[1] This draft is for a civil or commercial claim. The same service also lists criminal, personal-status and labour courts, each with the requirements of its own classification.

2. Claimant and defendant

Claimant: [name, ID, national address, capacity: in person / agent / guardian].

Defendant: [name, ID or commercial register, address]. Defendant’s representative, if any: [●].

›Drafting note

The service requires an ID for the claimant and the defendant, and a national address. If an agent files, the power of attorney must be in force and include authority to plead: see the power of attorney template. A guardian needs a guardianship deed that is in force. The defendant’s identity must be known before the claim can be filed.[1]

3. Subject of the claim

The claimant asks for [the order, the sum or the obligation] arising out of [the contract or the event] dated [●].

›Drafting note

Keep the subject to one sentence a reader can repeat. The narrative belongs in the facts.

4. Facts

  • (1) [First fact, with the date].
  • (2) [Second fact].
  • (3) [What was demanded before the claim, if anything, and the result].
›Drafting note

Number the facts in time order. Don’t mix the request into the story.

5. Legal grounds

The claimant relies on the provision it identifies: [cite the provision you rely on]. Do not leave this blank when you file.

›Drafting note

This template does not pre-fill article numbers. Find the provision with legal research, then have a lawyer read it. The service card says the related texts are the Commercial Courts Law and its implementing regulation, the Sharia Procedure Law and its implementing regulation, the Criminal Procedure Law and its implementing regulation, and the appeals regulation. This page does not reproduce those texts.[1]

6. Documents

The claimant attaches what Annex 1 lists. Supporting documents may be required, depending on the classification.[1]

7. Requests

  • (1) Order the defendant to [the principal request].
  • (2) [An alternative request, if any].
  • (3) Costs, if the court finds a basis for them.
›Drafting note

This page states no court-fee figure. The fee field on the service card is not restated here as a rule for every claim.

8. Signature and the attorney’s details

Person filing: name [●] · capacity [in person / agent] · power of attorney no. [●] · signature [●] · date [●]

Address for service: [●]

›Drafting note

If an agent signs, attach a power of attorney that is in force and includes authority to plead. Draft it with the power of attorney template, then issue it through the official channel.[3][1]

FAQ

Frequently asked questions

What are the basic particulars of a statement of claim?

The Najiz service lists an ID for the claimant and the defendant, a national address, the classification and its requirements, the claim data and the parties, and supporting documents where they are needed. An agent needs a power of attorney that is in force and includes authority to plead. A guardian needs a guardianship deed that is in force.[1] This template adds numbered facts, grounds and requests.

How do I file a claim electronically?

Sign in to Najiz with National Single Sign-On, open all electronic services, open the judiciary package, open “Statement of claim”, and start a new request. Enter the classification and read its requirements, enter the claim and the parties, attach the documents, and submit. The service does not require a court visit unless an SMS asks for one.[1]

Must I appoint a lawyer?

The service is available to the beneficiary in person. If someone else files as agent, the power of attorney must be in force and include authority to plead.[1] The card does not say that a lawyer is required for every claim. Having the draft reviewed before you file is a separate question, and it is the next one.

Do I need a lawyer?

Yes, before you sign. Have the final text reviewed by a lawyer licensed in your jurisdiction.
