In Saudi Arabia, the Ministry of Justice e-service “Issue a power of attorney” issues it on Najiz without a visit to a notary. An electronic power of attorney does not run for more than one year. Any party can partially withdraw from it on Najiz or in the Najiz app, and it ends automatically if a party dies.[1] Finalise the wording here, then issue it on Najiz. In Abu Dhabi, the Judicial Department’s notary public notarises customary documents, and the Department has an English-language notary bureau.[5] Check the notary of the emirate where the power of attorney will be used. The UAE Ministry of Justice publishes an e-Notary page.[6]

A free bilingual power of attorney for the GCC, general or special. It records the principal, the agent, the powers, the duration and revocation. It is not a substitute for the issued instrument. For the definitions, see power of attorney and notary public in the glossary. To file a claim, see the statement of claim template, and to answer one the statement of defence.

General or special?

In this template a general power of attorney covers the class of acts you tick. A special one names one act or transaction. Delete the option that doesn’t apply. The instrument issued on Najiz is the one that binds, after you choose the clauses, the duration and approve.[1]

  • Fill in the [placeholders]: both parties’ identity, capacity, any special act, and the term.
  • In Annex 1 mark “yes” for each power you intend to issue, and write its limit.
  • Out of scope: this draft is not the issued power of attorney. Representation on Najiz requires a power of attorney that is in force and includes authority to plead.[3]
  • This page states no notary fee, no rule on the language of a UAE power of attorney, and no attestation rule for a foreign one.

General and special power of attorney

In Saudi Arabia an agency in general words that does not specify the type of act is not valid (Article 482 of the Civil Transactions Law). A special agency is valid for a defined type of act (Article 483). Any act beyond administration needs a special agency (Article 484).[7]

In Oman an agency is special if it is limited to one or more defined matters, and general if it covers every matter that accepts representation (Article 675 of the Civil Transactions Law). A general agency lets the agent carry out exchanges and dispositions, other than donations, settlement, release, arbitration, loans and matters of personal status, unless the instrument authorises them (Article 677). An agency in general words that are not joined to anything that shows what is meant authorises only acts of administration and preservation (Article 678).[8] The contrast: general words that do not name the type of act do not create an agency in Saudi Arabia. In Oman a general agency has the scope Article 677 sets, and those acts stay outside it unless they are written in.

  • In the template, delete the option that does not apply. On Najiz, choose the clauses one by one. The draft is not the issued instrument.[1]
  • If the recipient accepts a letter that is not notarised, that is an authorization (تفويض). Use the authorization letter. This page stays the power of attorney. For the definition, see power of attorney.
  • UAE, Bahrain, Qatar and Kuwait: the general-versus-special scope is under review, so no article number is stated for it.

The template

Power of attorney

A draft general or special power of attorney for the GCC: parties, a checklist of powers, limits, duration and revocation. It is not a substitute for the instrument issued through the official channel. Replace every [placeholder] and delete the option that doesn’t apply.

1. Parties

I, [Principal: name, ID, address], being of full capacity, appoint [Agent: name, ID, address] to act for me within the limits of this power of attorney.

The Principal’s capacity: [in person / as agent under a power of attorney / owner of an establishment / representative of a company].

›Drafting note

The electronic service requires the beneficiary to be a Saudi or a resident with a valid ID, over 18, of full capacity, and with an active National Single Sign-On account. A company representative or an establishment owner uses Najiz Business.[1] If an agent files a statement of claim on Najiz, the power of attorney must be in force and include authority to plead.[3]

2. Type

Option — general: the Agent may do the acts ticked in clause 3, unless clause 4 excludes an act.

Option — special: this power of attorney is limited to this act: [describe the act or transaction].

›Drafting note

Delete the option that doesn’t apply. On Najiz the principal chooses the clauses one by one. The issued instrument is the one that binds, not this draft.[1]

3. Scope of authority

The Agent may exercise only the powers marked in Annex 1, and only within the limit written against each power.

›Drafting note

Don’t leave a power open if you mean one transaction. Check the clauses Najiz offers before you approve the issue.[1]

4. Limits and excluded acts

The Agent may not: [gift / release a claim / settle / waive a right / dispose of property / borrow / other exclusions]. Anything not listed in clause 3 and Annex 1 is outside this power of attorney.

›Drafting note

This draft is not a substitute for the issued power of attorney. If the principal’s ID has expired, the Najiz service offers only the clauses for claims and courts.[1]

5. Right to delegate

Option: the Agent may not appoint a substitute.

Option: the Agent may appoint a substitute within [limits], and remains responsible for that choice.

›Drafting note

Delete the option you will not issue. Najiz distinguishes the capacity “agent under a power of attorney”.[1]

6. Duration and expiry

This power of attorney runs from [date] until [date or event], unless it ends sooner by revocation, withdrawal or death.

›Drafting note

An electronic power of attorney on Najiz does not exceed one year.[1] This page states no longer maximum, and no notary fee.

7. Revocation and withdrawal

The Principal may revoke the Agent by written notice. The Agent may withdraw by written notice. Tell the other party, and any third party dealing with the Agent, when that is possible.

›Drafting note

On the electronic service, either party, principal or agent, may partially withdraw from the power of attorney on Najiz or in the Najiz app at any time. It ends automatically if a party dies, through the link with the Ministry of Interior. Its validity can be checked on the verification services.[1] A person over 65 who has never issued a power of attorney issues the first one through the virtual notary or a licensed notary, and may issue later ones electronically.[1]

8. How to use this draft

Use this draft to settle the wording. The power of attorney that works is the one issued on Najiz or before the competent notary. If the Arabic and English texts conflict, the Arabic text prevails in Saudi Arabia.

Principal: name [●] · ID [●] · signature [●] · date [●]

Agent: name [●] · ID [●] · signature [●] · date [●]

›Drafting note

The Najiz service says the electronic power of attorney does not need to be printed, stamped or signed on paper.[1] The signature lines above are for a draft you review before issue.

FAQ

Frequently asked questions

What is the difference between a general and a special power of attorney?

In this template a general power of attorney covers the powers you select from the checklist, and a special one names a single act. Delete the other option. The Najiz service asks you to choose the clauses and the duration, and the instrument issued after approval is the one that binds.[1] The statutory contrast for Saudi Arabia and Oman is in “General and special power of attorney”.

How do I issue an electronic power of attorney?

Sign in to Najiz with National Single Sign-On, open all electronic services, open the agencies and declarations package, open “Issue a power of attorney”, and start a new request. Enter the principal and the agent, choose the clauses and the duration, then approve. An SMS confirms the issue. The electronic issue does not require a visit to a notary.[1]

Can the power of attorney be revoked?

Within what the service states: either party, principal or agent, may partially withdraw from it electronically on Najiz or in the Najiz app. It ends automatically if a party dies.[1] This page states no other route of revocation beyond the service and clause 7 of the draft.

Do I need a lawyer?

Yes, before you sign. Have the final text reviewed by a lawyer licensed in your jurisdiction.
